Last updated: 24-05-2010 easyFairs© PACKAGING INNOVATIONS 2010 ![]() On 13-14 April 2010, the second edition of easyFairs© PACKAGING INNOVATIONS took place at EXPO XXI in Warsaw. During two busy days, exhibitors from Poland and other parts of Europe presented different offers of innovative solutions for the packaging, as well as the newest methods of printing. The visitors had an opportunity to talk about strategy for legal protection of innovative packaging by obtaining a patent, a protection right for utility model, an industrial design registration, as well as to discuss registration of trademarks issues at PATPOL's exhibition. Moreover, on 14 April 2010, Tomasz Rychlicki, a lawyer from the Trademark Department of PATPOL, gave a lecture entitled "The protection of Innovative packaging in Polish and European intellectual property law". During this short lecture a brief overview of the Polish and European intellectual property law that could be used for the effective innovative packaging protection, was presented. Participants had also an opportunity to learn about how to obtain legal protection, e.g. for trademarks or industrial designs. "Industrial desin registration for protecting product appearance" by Joanna Piłka The external appearance of a product is an important element of promotion and strategy of creating the image of a company as well as the products that it is manufacturing. An interesting appearance increases the value of the product, raises its attractiveness and attracts the customers' attention, which allows to gain the advantage over competition on the market. In order to find the answer to the above question, one should look at several aspects of the problem, namely: economic, socioeconomic and health-related, with focus on potential health hazards of using such counterfeit cosmetics. The Singapore Treaty on the Law of Trademarks in Poland On July 2, 2009 the Singapore Treaty on the Law of Trademarks and the Regulations under the Singapore Treaty on the Law of Trademarks came into force in the territory of the Republic of Poland. Both the Treaty and procedural Regulations thereto were adopted during a diplomatic conference held in Singapore from 13 to 27 March 2006. The purpose of the Singapore Treaty is further harmonization of trademark registration procedures commenced earlier at international level under the 1994 Trademark Law Treaty of Geneva. The Singapore Treaty is applicable to all types of trademarks registered in accordance with national laws (trademarks, service marks and collective marks, certification marks and guarantee marks.). The contracting States are free to choose the forms of communication (including electronic means), in which the offices responsible for receiving trademark applications and registration of marks correspond with the parties to the proceedings. The Treaty has introduced a number of new regulations, namely those regarding changes in trademark registers, recordal of trademark licenses, as well as those concerning formal requirements for professional representatives. Hague System for the International Registration of Industrial Designs - Accession of Poland On July 2, 2009, the Geneva Act (1999) of the Hague Agreement concerning the International Registration of Industrial Designs entered into force in respect of Poland. "How to prevent intellectual piracy" - Warsaw, 25 April 2008 We are pleased to announce that PATPOL supported the conference on "How to prevent intellectual piracy" which was held at the Auditorium of the National Library in Warsaw on April 25, 2008. The conference was organized by the Polish Patent Office in cooperation with ZAIKS - Society of Authors and Anti-Piracy Coalition (founded by ZPAV, Business Software Alliance, FOTA - Polish branch of MPA). The aim of the conference was to exchange opinions and discuss the current views on the status of protection of authors' rights in Poland, as well as to share knowledge regarding the prevention of intellectual property rights infringement. The MIP awards follow the publication of the magazine’s well-established IP survey in February and March this year. TRIPS in Poland - Decision of the Supreme Administrative Court On 8 February 2006 the Supreme Administrative Court in Poland judging in bench of composed of seven judges decided that Article 33 of TRIPS Agreement in relation to Article 70 item 2 of TRIPS Agreement is self executing and ought to be applied directly. Consequently, the duration of patents granted for period of 15-years and being valid in Poland on the date when the TRIPS Agreement entered into force for Poland, can be prolonged to the period of 20-years by virtue of the individual decisions of the Patent Office. The 20-years period of patent protection is calculated as from the date of filling the patent application. (reference symbol of the case: II GPS 1/05). SUPERBRANDS Event Mrs. Anna Zakrocka, a patent attorney, Head of Trade Mark Department of Patpol and a member of the council of SUPERBRANDS - the international independent arbiter on branding, participated in the final contest of the Polish brandleaders event. The event took place in Warsaw, on February 2, 2005 and the brands regarded by the Council as leading on the Polish market in various categories were awarded prizes
